1. ACCEPTANCE OF THESE TERMS
These Terms of Use (the “Terms”) govern your access to and use of the Misters website, online store, content, products, and related services (collectively, the “Site”). The Site is operated by Misters LLC (“Misters,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. PRIVACY
Our Privacy Policy explains how we collect, use, disclose, and protect information associated with your use of the Site. By using the Site, you acknowledge the practices described in that policy. The Privacy Policy should be read together with these Terms.
3. ELIGIBILITY AND ACCOUNT RESPONSIBILITY
You must be legally capable of entering into a binding agreement to use the Site or make a purchase. If you create an account, you are responsible for keeping your login credentials confidential and for activity occurring through your account. Information you provide must be current, complete, and accurate.
4. ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase the products identified in your cart. An order confirmation only acknowledges that we received your request; it does not mean the order has been accepted or shipped. We may accept, refuse, limit, or cancel an order for legitimate reasons, including product availability, pricing or description errors, payment issues, suspected fraud, violation of these Terms, or suspected unauthorized resale.
If we cancel an order after payment has been captured, we will refund the amount paid for the canceled item or order to the original payment method. We may request additional information to verify an order before accepting it.
5. PRICING, PAYMENT, AND TAXES
Prices are shown in U.S. dollars and may change without notice. Applicable sales tax, shipping charges, and other disclosed charges will be calculated during checkout. You authorize Misters and its payment processors to charge the payment method submitted at checkout for the full order total. Billing and shipping information must be accurate and complete.
We make reasonable efforts to display accurate prices and product information. If a material pricing or listing error occurs, we may cancel the affected order and issue a refund rather than fulfill it at the incorrect price.
6. FINAL SALE, CANCELLATIONS, AND ORDER CHANGES
ALL SALES ARE FINAL. We do not accept returns or exchanges for change of mind, fit, sizing, color preference, or other buyer preference. Once an order is placed, it cannot be canceled, modified, combined with another order, or redirected to a different address.
This final-sale policy does not limit any remedy that cannot legally be waived. If an item arrives defective, materially damaged, or different from what you ordered, contact hi@misters.world within five (5) calendar days after delivery. Include your order number and clear photographs of the item, packaging, and shipping label. Do not send merchandise back without authorization. If a claim is approved, Misters will provide an appropriate remedy consistent with applicable law.
7. SHIPPING AND DELIVERY
Processing and delivery estimates are estimates, not guarantees. Weekends, holidays, limited releases, carrier delays, severe weather, and periods of high order volume may extend fulfillment times.
We will ship within the timeframe stated on the Site or in your order materials. If no shipment timeframe is stated, we will handle the order as required by applicable law. If we cannot ship within the applicable timeframe, we may contact you to obtain consent to a delay or provide the cancellation and refund options required by law.
If tracking shows delivery but you cannot locate the package, contact the carrier first and then contact us. Carrier investigations and remedies may apply. Nothing in this section limits rights that cannot be waived under applicable law.
8. PRODUCT DESCRIPTIONS, COLOR, FIT, AND AVAILABILITY
Misters products may include garment dyeing, washing, distressing, vintage-inspired finishing, handwork, or other processes that create natural variation. Color, texture, measurements, fading, placement, and finish may vary slightly from one item to another. These variations are part of the product and are not necessarily defects.
We try to present products accurately, but screen settings, photography, lighting, production variation, and measurement methods can affect how products appear. Product descriptions, measurements, availability, imagery, and specifications may be corrected or updated without notice. Items may sell out at any time.
9. LIMITED RELEASES, QUANTITY LIMITS, AND RESALE
Products sold through the Site are intended for personal use unless Misters expressly agrees otherwise in writing. We may limit quantities per person, household, payment method, account, device, or address. We may refuse or cancel orders that appear to involve bots, automated purchasing, circumvention of purchase limits, fraud, or unauthorized commercial resale.
10. OWNERSHIP AND PERMITTED USE
The Site and all content made available through it—including names, logos, trademarks, product names, graphics, artwork, photographs, video, audio, text, layout, design, software, and trade dress—are owned by or licensed to Misters and are protected by intellectual-property and other laws.
Misters grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, publish, distribute, sell, license, modify, create derivative works from, publicly display, scrape, reverse engineer, or commercially exploit the Site or its content without prior written permission from Misters, except where applicable law expressly permits otherwise.
11. PROHIBITED CONDUCT
You may not use the Site to:
violate any law, regulation, court order, or the rights of another person;
upload or transmit unlawful, infringing, deceptive, threatening, harassing, hateful, obscene, or privacy-invasive material;
introduce malware, viruses, malicious code, or technology intended to disrupt or damage the Site or another system;
scrape, crawl, harvest, index, probe, test, or access the Site through unauthorized automated means;
circumvent security controls, purchase limits, access restrictions, or anti-bot measures;
interfere with the operation of the Site or another person’s use of it;
impersonate another person, misrepresent an affiliation, or submit false billing, shipping, or account information; or
use Misters content, trademarks, or product imagery to create confusion, imply endorsement, or support counterfeit or unauthorized resale activity.
12. THIRD-PARTY SERVICES AND LINKS
The Site may use or link to third-party services, including payment processors, shipping carriers, social platforms, and external websites. Misters does not control and is not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service may be governed by separate terms and policies.
13. SITE AVAILABILITY, SUSPENSION, AND CHANGES
We may modify, suspend, restrict, or discontinue any part of the Site at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk for Misters or others, or used the Site fraudulently or unlawfully. We are not responsible for interruptions caused by maintenance, third-party services, network failures, events beyond our reasonable control, or other operational conditions.
14. SITE DISCLAIMER
The Site and its content are provided on an “as available” basis. Misters does not promise that the Site will always be uninterrupted, secure, or error-free. This section relates to operation of the Site and does not exclude product warranties, remedies, or consumer rights that cannot lawfully be excluded.
15. GOVERNING LAW
These Terms are governed by the laws of the State of California, except where another law must apply. Nothing in these Terms limits any non-waivable right or remedy available under applicable consumer law.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time. Revised Terms become effective when posted with a new effective date, unless a later date is stated. Changes apply prospectively. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.
17. GENERAL PROVISIONS
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Misters’ failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Misters may assign them as part of a merger, reorganization, financing, asset transfer, or other business transaction. Provisions that by their nature should continue after termination will remain in effect, including ownership and governing-law provisions.
These Terms, together with the Privacy Policy and any product-specific terms presented at purchase, form the entire agreement between you and Misters concerning the Site and supersede prior communications on the same subject. If product-specific terms conflict with these Terms, the product-specific terms control for that product.
